Wachovia to Pay $39 Million in Proposed Settlement of Stock Broker Overtime Class Action
A preliminary settlement of $39 million was approved this week by a federal judge in California for a class action lawsuit involving some 10,000 stock brokers who allege they were not compensated for overtime and paid other wages owed them by Wachovia Corp.
Casey’s Wage and Hour Class Actions Reach Proposed $11.7 Million Settlement
Casey’s General Stores Inc., have reportedly reached settlements of 2 wage and hour class action lawsuits filed by plaintiffs representing about 7,800 current and former assistant managers, as well as 76,000 current and former non-management-level store employees.
The settlement of $11.7 million is subject to court approval.
Proposed Settlement Reached in Aerotek Employment Class Action
Call center staff who sued their employer, Aerotek, have reached a proposed $1.2 million settlement. Over 1,300 employees were involved in the class action suit which stemmed from action taken by the company in April 2007, and resulting allegations that Aerotek took away employees' accrued leave.
If the settlement is approved, the plaintiffs could receive funds by midsummer.
FedEx Ground Business Model Wins Class Action in Washington
FedEx Ground delivery drivers today found themselves on the wrong end of the Superior Court of Washington for King County ruling in a class action they brought in 2004. The court ruled that the delivery drivers are not employees but independent contractors, and therefore not entitled to overtime and reimbursement of uniform costs.The class action involved 320 drivers who alleged the company was wrongly referring to them as entrepreneurs rather than employees.
This is the first case challenging the FedEx Ground business model to be tried by a jury. A similar, national class action is pending in Indiana, involving 30,000 former and current FedEx contractors.
